I have a female friend of mine who is currently living in New York with a service member. She has three children. She asked for a divorce in New York, but was told that if she moved back to her home state of Tennessee with him that he would divorce her. She has had an extra marital affair. Is there any legal reason why this would be more beneficial to him in one state as opposed to another? And is an extra marital affair in New York and then moving back to Tennessee enough to make it worth his while to wait until they move? There is plenty of evidence for emotional abuse on his side and enough evidence of infidelity on hers. Could this simply be a way of tipping the scales in a "no fault" state where equitable division is the usual course to a state where infidelity may have a larger implication on alimony, child support, and property distribution?... read more
